Detailed below are the terms and conditions of hire between
Production Technology LLC (Protec) and its client (Client).
Hire Period
This is defined as the period of time from the date that the
equipment leaves the warehouse of Protec to the date that it is
returned to the warehouse of Protec. These dates will be agreed
between Protec and Client prior to the transit of equipment from
Protec's warehouses and stated on the quotation supplied by Protec
to Client. Any adjustment to this hire period after the date that
the equipment leaves Protec's warehouses, whether an extension or
reduction to the overall period, should be negotiated at the time
and will be invoiced to Client as a variation.
Equipment
The equipment, the subject of an individual hire, is the
property of Protec and will remain the property of Protec throughout
the hire period. Protec will check the equipment prior to delivery
to Client. Protec will supply suitably qualified personnel to
operate the equipment.
Confirmation Of Hire
Confirmation of hire is only recognized as such after the
receipt by Protec of a signed fax authority, or signed letter from
Client agreeing to all related terms and costs of hire as detailed
in the quotation supplied by Protec. It is subject to the Exclusions
and Terms as outlined in the relevant page of this quote.
Variations
All variations as regards to equipment, location, hire period
and personnel should be negotiated and agreed in writing with Protec
by Client and signed by both parties. These variations and any
related charges would be invoiced to Client accordingly.
Payment Terms
Unless otherwise indicated on the quotation supplied by Protec
to Client, it is agreed that the payment terms are as follows:
50% payment upon receipt of the written confirmation order by Protec
from the hiree.
50% payment upon the completion of the installation of the equipment
at the designated venue.
Variations - These will be billed separately and will be payable
according to the above terms. If the variations have been negotiated
and agreed post the completion of the installation stage then all
variations become payable immediately.
Breach of Payment Terms - In the event of failure by Client to
adhere to the agreed payment terms, then Protec reserves the right
to consider that Client is in breach of contract and liable to the
applicable cancellation fees.
Cancellation fees - all cancellation fees as detailed below are
payable immediately upon receipt by Protec of signed fax
confirmation of the cancellation.
Cancellation & Postponement Penalties
Cancellation 14 calendar days or less from the commencement of
the hire period will result in a 100% cancellation fee equivalent to
the full value of the job.
Cancellation 1 calendar month or less, but greater than 14
calendar days will result in a 50% cancellation fee equivalent to
50% of the full value of the job.
Cancellation in excess of 1 calendar month will result in no
cancellation fee being charged.
All cancellation fees are payable immediately upon receipt by
Protec of signed fax confirmation of cancellation from Client.
Postponement penalties are identical to the cancellation fees
detailed above, but 50% of their value will be credited to client
when the job is reinstated.
